Defendant
Given 25 Years in Child Sexual Abuse Case
David Frasier was convicted Thursday of Assault and Battery
of a High and Aggravated Nature (ABHAN), Lewd Act on a Minor, and Dissemination
of Harmful Materials to a Minor.
Frasier had been the boyfriend of the victim’s mother and
had been living with the victim, her mother and younger brother for several
years. It was during this time that he began to sexually assault the victim,
Charleston police said.
The 35-year-old man was later sentenced by Circuit Judge
Cooper to 25 years in prison.
A key piece of evidence in the trial was a pornographic video
Frasier showed the victim. During testimony, the victim described scenes from
the video, which were confirmed by police to be on a tape found in the
defendant’s bag at the time of his arrest.
Police were also able to recover bedding from the room
where the victim testified the assault had occurred and confirmed Frasier’s DNA
was present.
Assistant Solicitor Deborah Herring-Lash had sought to
convict Frasier of Criminal Sexual Conduct with a Minor, but after three hours
of deliberation the jury convicted him of the lesser, included offense of ABHAN.
